为逃避安全监管监察，部分煤矿采取隐蔽工作面违法生产，当前已经成为导致生产安全事故的恶性“毒瘤”“炸弹”。为督促煤矿企业深刻汲取事故教训，重拳打击煤矿隐蔽工作面违法生产行为，有效防范煤矿生产安全事故，近期，国家矿山安全监察局出台了《严惩煤矿隐蔽工作面违法生产办法》（以下简称《办法》）。

《办法》聚焦煤矿隐蔽工作面的风险研判、检查内容、惩处措施，明确了严厉打击隐蔽工作面的目的及原则等。《办法》结合监管监察执法日常工作有效经验做法，对隐蔽工作面风险分析研判、重点关注对象等内容提出明确要求，提出了应当从风量分配、用电量监测等9个方面开展逐因素分析，着力解决执法人员“不会查”的问题。在惩处措施方面，对煤矿企业提出要通过采取联合惩戒、“行刑衔接”、列入严重失信主体名单等措施倒逼落实主体责任，着力形成对蓄意违法违规行为的高压态势，对监管部门提出要通过约谈曝光、责任倒查、依纪移送等手段督促落实属地监管责任，着力解决执法人员“不愿查”的问题。在做好“后半篇文章”方面，强调要紧盯问题查处的整改闭环，着力强化组织实施，持续深化打击隐蔽工作面违法生产行为。

国家矿山安全监察局将督促煤矿安全监管监察部门建立长效机制，强化严格执法，常态化推进清理隐蔽工作面，坚决清除存量遏制增量，全力防范隐蔽工作面违法生产引发的生产安全事故。

The "Measures" focus on the risk analysis, inspection content and punishment measures of hidden working faces in coal mines, and clarify the purpose and principles of severely cracking down on hidden working faces. Combined with the effective experience in the daily work of supervision, supervision and law enforcement, the "Measures" put forward clear requirements for the risk analysis and judgment of hidden working faces and the key focus objects, and put forward that factor by factor analysis should be carried out from nine aspects such as air volume distribution and electricity consumption monitoring, and strive to solve the problem that law enforcement personnel "will not check". In terms of punitive measures, the coal mining enterprises proposed to force the implementation of the main responsibility by taking joint punishment, "execution connection", including the list of serious untrustworthy subjects, and other measures, focusing on forming a high-pressure situation for intentional violations of the law and regulations, and the regulatory authorities proposed to urge the implementation of territorial regulatory responsibilities through interviews and exposure, liability reverse investigation, and disciplinary transfer. Efforts should be made to solve the problem of law enforcement officers' reluctance to investigate. In terms of doing a good job in the "second half of the article", it is emphasized that we should focus on the closed-loop rectification of problem investigation, focus on strengthening the organization and implementation, and continue to deepen the crackdown on illegal production behaviors of hidden working faces.

The State Administration of Mine Safety Supervision will urge the coal mine safety supervision and supervision departments to establish a long-term mechanism, strengthen strict law enforcement, normalize the clean-up of hidden working faces, resolutely remove the inventory to curb the increase, and spare no effort to prevent production safety accidents caused by illegal production of hidden working faces.
